MN Gov Pawlenty To File Healthcare Bill Lawsuit On His Own

It passed narrowly in the house and the majority of the public remains opposed to the new health care law in its current form. Attorney Generals from a number of states have filed lawsuits challenging the constitutionality of the bill that Joe Biden described with an obscenity during a press conference. Minnesota’s attorney general did not follow a suit, but the governor has taken his own initiative.
New Healthcare Bill Is Unconstitutional
Critics of the bill challenge one of the key provisions of the bill. The reform package requires private citizens to enter into a business deal with a private industry. This law marks the first time that the federal government has required a private citizen to buy any goods or services. If a person does not have health insurance or does not pay adequate health insurance, he may be fined. Under the new provision, the Internal Revenue Service will determine if a person has adequate coverage.
Pawlenty announced his plans to file a lawsuit challenging the new bill this Monday. He did not announce whether he will file the suit on his own or join with the 14 state attorney generals already preparing a case against the new law.
Political Issue In November
Pawlenty may run as a Republican candidate in 2012, but how a senator voted on the health care reform bill will be one of the key issues in the mid-term elections this November. The public opposition to the attempt to take over one-sixth of the American economy may not be perceived as favorably as the Obama administration hopes. The lawsuits filed in district court have not had the hearing date set. The issue of the constitutionality of the new law will likely be settled in the supreme court.
